These Terms of Service (“Terms”) govern your access to and use of the Magic Santa Calls mobile application and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.

- Magic Santa Calls is for parents/guardians to book and manage Santa-themed phone calls for children.
- You must have permission to contact the call recipient and provide any child details you enter.
- Calls may use automated/AI systems and third-party providers to deliver the experience.
- Tokens are used to book calls; tokens may be reserved when you book and may be refunded in certain cases (like failed/missed calls).
- Purchases are handled by the App Store/Google Play and/or other payment providers; refunds follow the applicable provider policies plus any in-app refund rules we publish.
- You can request account deletion; associated data may be anonymized as part of deletion.

1. Who We Are
The Service is provided by Digital Daydream LLC (“Magic Santa Calls,” “we,” “us,” “our”).

2. Eligibility; Parent/Guardian Use; Children
The Service is intended for use by parents and legal guardians (or other adults with appropriate permission) to create and manage call experiences for children.
- The Service is not directed to children and children should not create accounts or use the app on their own.
- You represent that you have the authority to provide information about a child and to book calls to the phone number you enter.
- You agree not to submit sensitive personal information in free-form text fields.
3. Accounts; Security
You may need an account to use certain features. You are responsible for:
- Keeping your account credentials secure
- All activity that occurs under your account
- Ensuring the information you provide is accurate (including phone numbers and scheduling details)
4. Service Description (Booking + Call Delivery)
The Service lets you:
- Create “child profiles” (for example: first name, birth year, optional birth month/day, language, and notes)
- Browse available experiences
- Book a call either immediately or for a scheduled time
- Receive notifications related to bookings and call outcomes
- Access call “artifacts” when available (for example, a recording URL and/or transcript)
4.1 Scheduling Rules and Limits
Scheduling features may enforce constraints, including:
- You must choose either “call now” or a scheduled date/time (not both).
- When scheduling a future call, you must provide a timezone.
- The Service may limit calls to a daily window (currently configured as 6:00–21:00 local time) and may limit retry attempts.
4.2 Call Delivery
Calls are delivered to a phone number you provide in international E.164 format. Delivery depends on network availability and third-party provider performance. We do not guarantee that a call will connect successfully or that audio quality will be uninterrupted.
4.3 Duration Limits
Calls may be subject to duration limits that vary by experience. The Service also enforces safety limits (including a hard upper bound) to prevent excessively long calls.
5. Consents and Communications
The Service may present required or optional consents as part of the booking process (for example, guardian consent, recording consent, acceptance of terms, and data processing consent).
By using the Service, you consent to receiving transactional communications related to your bookings and purchases, such as:
- Email confirmations and reminders
- In-app or push notifications
- Call-related status notifications
6. Recording & Call Artifacts
Some experiences may support call artifacts such as:
- Recordings (for example, an audio recording URL)
- Transcripts (for example, transcript segments or full text)
- Summaries (when available)
If a recording consent is required for an experience, you must provide it before booking. You are responsible for ensuring you have all required permissions and legal authority to record or receive recordings of calls to the phone number you provide.
Artifacts may be unavailable due to provider limitations, call failures, connectivity issues, or configuration.
7. Tokens, Credits, and Billing
7.1 Token Model
The Service uses “tokens” (or credits) to access call experiences. When you book a call, the Service may reserve some tokens for that booking. Token requirements may depend on the selected experience and may be based on a per-minute baseline or other experience configuration.
7.2 Refunds of Reserved Tokens (Call Outcomes)
The Service includes automatic token-release behavior tied to booking outcomes, including:
- Cancellation: reserved tokens may be returned if you cancel before a call starts.
- Failed/Missed: reserved tokens are intended to be returned when a call fails or is missed.
Token availability and refunds are recorded in the Service’s systems and may not be instantaneous in all cases.
7.3 Purchasing Tokens
Token purchases may be offered through:
- Apple App Store In‑App Purchases (iOS)
- Google Play In‑App Purchases (Android)
- Other checkout flows (for example, Stripe) where available
All purchases are subject to the applicable store/provider terms and policies. Taxes may apply.
7.4 Monetary Refunds for Purchases
We refund purchased tokens in accordance with the applicable store/provider terms and policies. Provider policy governs, but we may grant replacement tokens/credits for failed experiences.
8. Cancellations, Rescheduling, No‑Shows
You can cancel certain bookings. Scheduling and cancellation rules may vary depending on whether a call has already started and the booking status at the time of cancellation.
9. Acceptable Use; Prohibited Conduct
You agree not to:
- Use the Service for unlawful, harmful, harassing, or abusive conduct
- Impersonate others or misrepresent your identity
- Submit content that violates others’ rights
- Attempt to access, probe, or disrupt the Service or its systems
- Book calls to recipients without permission
We may suspend or terminate access for violations or suspected abuse.
10. Intellectual Property
The Service (including its design, software, and content) is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
10.1 Your Content
If you submit content (for example, booking notes, customization inputs, or messages), you grant us a limited license to use it solely to operate, improve, and provide the Service.
11. Third‑Party Services
The Service relies on third‑party services to operate, which may include:
- A database/auth provider (Supabase)
- A voice/call orchestration provider (Vapi)
- AI services used for call steering/classification (OpenAI)
- Email delivery (Resend)
- Push notifications (OneSignal)
- Scheduling/queueing and caching (Upstash/QStash and Redis)
- Payments (Apple/Google in-app purchases, Stripe, and/or RevenueCat infrastructure)
Third‑party services may have their own terms. We are not responsible for third‑party services outside our control.
12. Availability; Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
We do not warrant that:
- Calls will always connect successfully
- Audio quality will be uninterrupted
- Artifacts (recordings/transcripts) will always be produced or retrievable
- The Service will be error-free or always available
Some experiences may involve automated systems. Outputs can vary and may occasionally be inaccurate or unexpected.
13. Limitation of Liability
We cap liability to the amount paid in the last 12 months.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages.
14. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service, including booking calls without permission or providing information you do not have rights to share.
15. Termination
We may suspend or terminate your access to the Service at any time if we believe you violated these Terms or if required for safety, security, or legal reasons. You may stop using the Service at any time.
16. Account Deletion
The Service supports account deletion. When you request deletion, associated records may be removed and/or anonymized (for example, removing emails, phone numbers, and child profile names) to prevent re-identification while preserving integrity of system records.
17. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will update the “Last updated” date and may provide additional notice.
18. Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved in the state and federal courts located in Sheridan County, Wyoming, and you consent to the exclusive jurisdiction and venue of such courts.
